XXIV. Appendix(EUROPEAN UNION)

If you are situated in the European Union (“EU”), the following provisions shall apply to you in addition to the above provisions. In case of a conflict, the provisions in this Section XXIV shall supersede any conflicting provision in one of the above sections.

Supplement to Sections II(CHANGES TO THE TERMS) of the Terms

In deviation from Section II of these Terms, we may change or modify the Terms with effect for the future if there is a valid reason for the amendment and insofar as the changes are reasonable taking into account NHN Corporation’s and your interests. A valid reason exists in particular if the changes are necessary due to a disruption of the equivalent relationship of the Terms to a not insignificant extent that was unforeseeable for us at the time of the conclusion of the Terms due to changes in case law or legislation. This does not cover any changes or modifications to a main performance obligation of the Terms. We will notify you of any changes as required by law and provide you a reasonable period of time to review them before they start applying (as a rule, 14 days). If you do not agree with the changed Terms, you will be able to terminate these Terms. However, by continuing to use the Services, you accept the changes to the Terms, which will take effect at the time they are posted or as otherwise required by applicable law.

Supplement to Sections III(YOUR ACCOUNT / PASSWORD SECURITY / SUSPENSION, TERMINATION) and V(VIRTUAL ITEMS) of the Terms

In deviation from Section III and V of these Terms, including any changes or updates that we determine are necessary to maintain the Services in conformity, we may, as we deem necessary in our business judgment, modify, update, or otherwise make any changes to the Services, in whole or in part, at any time.

We will notify you of such changes in the same manner as we notify changes to the Terms, and you may terminate the Terms if these changes negatively impact your access to or use of the Services (other than in a minor way).

NHN Corporation may terminate these Terms at any time, in which case we will give you as much advance notice as is reasonably practicable, at least a 14-day advance notice. 

Supplement to Section XIII(DISCLAIMERS AND LIMITATION OF LIABILITY) of the Terms

In deviation from Section XIII of the Terms, these Terms do not exclude or limit the legal liability of NHN Corporation in the event of your death or personal injury resulting from an act or omission of NHN Corporation. 

Supplement to Section XV (APPLICABLE LAW; JURISDICTION) and XVI (BINDING ARBITRATION) of the Terms

In deviation from Section XV of the Terms, the choice of law does not exclude the application of those consumer protection provisions in the applicable laws of your country of residence that may not be derogated from by contract. As a consumer, you may bring any judicial proceedings relating to these Terms before the competent court of your place of residence or the competent court of NHN Corporation’s place of business.

Section XVI of the Terms does not apply.

As a resident of the EU, you may also address the European Commission through its Online Dispute Resolution (ODR) platform for EU consumers: https://ec.europa.eu/consumers/odr. However, we do not participate in this platform.

Supplement to Section XVII (INDEMNITY) of the Terms

Section XVII only applies to the maximum extent permitted by applicable law.

Supplement to Section XXI (ASSIGNMENT) of the Terms

In deviation from Section XXI of the Terms, NHN Corporation may assign or transfer these Terms in accordance with applicable law. Subject to the foregoing, these Terms shall be binding upon and inure to the benefit of the parties, their successors, and permitted assigns.
